Matter of Greene v. Lombardi

Appellate Division of the Supreme Court of New York, First Department
Jun 3, 1999
262 A.D.2d 35 (N.Y. App. Div. 1999)

Opinion

June 3, 1999.

Appeal from the Supreme Court, New York County (Richard Braun, J.).

No appeal lies from an order entered on default (CPLR 5511). Petitioner's remedy is a motion to vacate the default, and if that motion is denied, appeal therefrom ( see, Nedell v. Sprigman, 227 A.D.2d 163).

Concur — Rosenberger, J.P., Mazzarelli, Rubin, Andrias and Buckley, JJ.
