In a proceeding under article 78 of the Civil Practice Act, to review and annul a determination of the Suffolk County Civil Service Commission that petitioner is not entitled to the permanent rank of captain on the Suffolk County Police Department on his transfer thereto on January 1, 1960, petitioner appeals from an order of the Supreme Court, Suffolk County, dated January 30, 1961 which dismissed his petition. Order affirmed, without costs. No opinion. Beldock, P.J., Christ, Hill, Rabin and Hopkins, JJ., concur. [ 30 Misc.2d 619.]
