Application by a disbarred attorney, pursuant to statute (Judiciary Law, § 90, subd. 5), to vacate the order of disbarment, dated January 10, 1936 and entered January 22, 1936, and to restore his name to the roll of attorneys and counselors at law. This is petitioner's third application for reinstatement; his two previous applications were respectively denied on June 18, 1951 and March 24, 1952. The present application was referred to an Official Referee for hearing and report together with his recommendation. After extensive hearings, the Referee has filed his report recommending that the application be denied. The report of the Referee is confirmed; the application of petitioner for reinstatement as a member of the Bar is denied. Nolan, P.J., Beldock, Ughetta, Kleinfeld and Christ, JJ., concur.
