Matter of Franklin

Appellate Division of the Supreme Court of New York, Third Department
Jan 20, 1971
36 A.D.2d 561 (N.Y. App. Div. 1971)

Opinion

January 20, 1971

Appeal from a decision of the Unemployment Insurance Appeal Board holding claimant disqualified from receiving benefits on the ground that she refused without good cause employment for which she was reasonably fitted by training and experience. The board's finding that claimant was reasonably fitted by training and experience to take the proffered job as secretary was a purely factual determination which we find is supported by substantial evidence and that finding is, therefore, binding upon us. ( Matter of Tucker [ Lubin], 8 N.Y.2d 1145.) Decision affirmed, without costs. Herlihy, P.J., Reynolds, Greenblott, Cooke and Sweeney, JJ., concur.
