Matter of Fox v. Schenck

Court of Appeals of the State of New York
Nov 14, 1973
304 N.E.2d 775 (N.Y. 1973)

Opinion

Argued October 9, 1973

Decided November 14, 1973

Appeal from the Appellate Division of the Supreme Court in the Second Judicial Department.

Louis J. Lefkowitz, Attorney-General ( Robert S. Hammer, Irving Galt and Stephen P. Seligman of counsel), for appellant.

J. Lewis Fox, pro se, and David L. Fox for J. Lewis Fox, respondent.

Order reversed, without costs, and the petition dismissed. In our opinion the revocation of respondent's licenses by the Superintendent of Insurance in the circumstances disclosed in this record did not constitute an abuse of discretion as a matter of law.

Concur: Chief Judge FULD and Judges BURKE, BREITEL, JASEN, GABRIELLI, JONES and WACHTLER.
