Matter of Ford v. Alger Machines Co., Inc.

Appellate Division of the Supreme Court of New York, Third Department
Apr 27, 1971
36 A.D.2d 877 (N.Y. App. Div. 1971)

Opinion

April 27, 1971

Appeal from a decision of the Workmen's Compensation Board, filed December 29, 1969, on the ground that there is no substantial evidence to support the board's finding of causal relationship. Claimant, a machinist's helper, suffered a compensable back injury on January 18, 1963. An award for disability was made covering the period from January 22, 1963 to March 4, 1963 and the case was closed. On August 1, 1968 the board ordered the case reopened on claimant's application. The Referee found that there was no causally related disability subsequent to March 4, 1963. The board reversed and found, that as a result of the accidental injury of January 18, 1963, claimant had a continuing 50% disability and is entitled to a further award from March 4, 1963. There is, in our opinion, substantial evidence to sustain the board's finding. Decision affirmed, with costs to the Workmen's Compensation Board. Herlihy, P.J., Staley, Jr., Cooke, Sweeney and Simons, JJ., concur.
