266 App. Div. 781 (N.Y. App. Div. 1943)

Opinion

May 3, 1943.

Present — Close, P.J., Hagarty, Carswell, Johnston and Taylor, JJ.

The grantor in a conveyance of real property appeals (a) from an order which confirmed the award of an arbitrator, directed judgment on the award in favor of the grantee, and denied the grantor's motion to vacate the award; and (b) from the judgment in favor of the grantee entered pursuant to the order. Order and judgment unanimously affirmed, with costs. The attack made upon the arbitrator in the papers and brief submitted for the grantor, in our opinion, is not justified.
