Order denying peremptory mandamus order reversed on the law, with costs, and the issuance of a peremptory mandamus order directed, with costs, on the ground that under the facts found on the trial there was no justification for the exercise of discretion by the court in denying the peremptory mandamus order. Van Kirk, P.J., Davis, Whitmyer, Hill and Hasbrouck, JJ., concur.
