Matter of Doxtater

Appellate Division of the Supreme Court of New York, Fourth Department
Mar 5, 1947
271 App. Div. 1049 (N.Y. App. Div. 1947)

Opinion

March 5, 1947.

Present — Taylor, P.J., Dowling, Harris, McCurn and Larkin, JJ.

Decree reversed on the facts and a new trial granted, with costs to appellant to abide the event, upon the ground that the findings of the jury upon the questions submitted to them were against the weight of evidence. All concur. (The decree denies proponent's motion to set aside the verdict of the jury and denies probate to the alleged last will of decedent.)
