Matter of Dierkes v. Dierkes

Appellate Division of the Supreme Court of New York, Second Department
Nov 6, 1967
28 A.D.2d 1127 (N.Y. App. Div. 1967)

Opinion

November 6, 1967

Order of the Family Court, Nassau County, dated March 2, 1967, modified, on the law and the facts, by reducing the amount of the counsel fee to be paid to respondent's attorney to $200, with proportionate reduction of the three installments, and by deleting the fifth ordering paragraph. As so modified, order affirmed insofar as appealed from, without costs. Under the circumstances disclosed we are of the opinion that (1) the award of $300 for a counsel fee was excessive and (2) the directive in the fifth ordering paragraph, which would place appellant under the supervision of the Nassau County Probation Department for 12 months with respect to his savings account, constituted an improvident exercise of discretion. Brennan, Acting P.J., Rabin, Hopkins, Benjamin and Munder, JJ., concur.
