Motion to dismiss appeal granted, with $10 costs, unless the appellant procures the record on appeal and appellant's points to be filed on or before December 13, 1955, with notice of argument for the January, 1956, term of this court, said appeal to be argued or submitted when reached. Appellant is directed to file a surety company bond in the sum of $250, as provided by section 298 of the Surrogate's Court Act, within five days after the entry of order on this motion.
