Matter of Dennis

Opinion

September 29, 1977

Cross motion to dismiss granted on the ground that an appeal from an intermediate order does not survive the entry of final judgment — in this proceeding, the order of disposition. (Jema Props. v McLeod, 51 A.D.2d 702.) If and when an appeal is taken from that order, this court may review the order entered on fact finding (CPLR 5501, subd [a], par 1), the separate appeal from which we now dismiss.

Concur — Murphy, P.J., Kupferman, Evans, Lane and Markewich, JJ.
