June 28, 1949.

Appeal from Unemployment Insurance Appeal Board.

Present — Foster, P.J., Heffernan, Brewster, Deyo and Santry, JJ.


The sole issue on this appeal is whether the Unemployment Insurance Appeal Board abused its discretion in denying appellant's application for a reopening and a reconsideration of its prior decision. Appellant took no appeal from the decision of the appeal board on the merits and the time to appeal therefrom has expired. We may not say on the record before us that the board abused its discretion. Decision unanimously affirmed, without costs.
