Matter of Conchita J. v. Scopetta

Appellate Division of the Supreme Court of New York, Second Department
Jun 5, 2000
273 A.D.2d 238 (N.Y. App. Div. 2000)

Opinion

Argued April 28, 2000.

June 5, 2000.

In a habeas corpus proceeding, the petitioner appeals from an order of the Family Court, Queens County (Salintro, J.), dated May 24, 1999, which, after a hearing, denied the petition.

Ronald R. Benjamin, New York, N.Y. (Sharon McDermott of counsel), for appellant.

Michael D. Hess, Corporation Counsel, New York, N.Y. (Pamela Seider Dolgow, Jane S. Earle, and Elizabeth S. Natrella of counsel), for respondent.

Monica Drinane, New York, N.Y. (Marcia Egger of counsel), Law Guardian for the children.

Before: CORNELIUS J. O'BRIEN, J.P., DANIEL W. JOY, DANIEL F. LUCIANO, ROBERT W. SCHMIDT, JJ.

DECISION ORDER

ORDERED that the order is affirmed, without costs or disbursements.

A writ of habeas corpus is not the proper procedure to seek review of the Family Court's fact-finding order of neglect entered upon the mother's default (see, People ex rel. Backus v. Broome County Dept. of Social Servs., 240 A.D.2d 786, 787-788; Matter of Eddie J., 273 A.D.2d 239 [decided herewith]). The proper procedure is to move to vacate the fact-finding order, and if the motion is denied, to appeal from the order denying the motion (see, Matter of Vanessa M. [Robert M.], 263 A.D.2d 542; Matter of Hurst v. Hurst, 227 A.D.2d 689).
