CONSIDERATION, by the Court of Appeals, on its own motion pursuant to N Y Constitution, article VI, § 22 (f), (g) and Judiciary Law § 44 (8) (b), (c) of whether Honorable Fred Cleveland should be suspended from his office of Town Justice of the Town of Kortright, Delaware County.

On the Court's own motion, it is determined that Honorable Fred Cleveland is suspended, with pay, effective immediately, from his office of Town Justice of the Town of Kortright, Delaware County, pursuant to N Y Constitution, article VI, § 22 (f), (g) and Judiciary Law § 44 (8) (b), (c).

Concur: Chief Judge KAYE and Judges SIMONS, TITONE, BELLACOSA, LEVINE and CIPARICK. Taking no part: Judge SMITH.
