CONSIDERATION, by the Court of Appeals, on its own motion pursuant to N Y Constitution, article VI, § 22 (f), (g) and Judiciary Law § 44 (8) (b), (c) of whether the suspension of Honorable Fred Cleveland from his office of Town Justice of the Town of Kortright, Delaware County, should be continued.

On the Court's own motion, it is determined that this Court's November 1, 1996 suspension of Honorable Fred Cleveland from his office of Town Justice of the Town of Kortright, Delaware County, is continued, with pay.

Concur: Chief Judge KAYE and Judges SIMONS, TITONE, BELLACOSA, SMITH, LEVINE and CIPARICK.
