Matter of Clark

Appellate Division of the Supreme Court of New York, Second Department
Nov 23, 1942
265 App. Div. 877 (N.Y. App. Div. 1942)

Opinion

November 23, 1942.

Present — Lazansky, P.J., Carswell, Johnston, Adel and Close, JJ.

Decree of the Surrogate's Court, Orange County, approving the trustees' account, modified on the law and the facts by reducing from $3,000 to $2,000 the amount awarded to the attorneys for the trustees for their services and allowance. As thus modified, the decree is unanimously affirmed, with costs to all parties filing briefs, payable out of the estate, and the matter is remitted to the Surrogate's Court for the entry of a decree accordingly. The evidence does not justify the higher award for attorneys' services.
