Petition herein dismissed as moot, the proceeding instituted by George F. Perkins against Jerome V. Pitney and others having been transferred by stipulation to the Special Term appointed to be held in and for the County of Saratoga on the 20th day of October, 1961. Coon, J.P., Gibson, Herlihy and Taylor, JJ., concur.
