CPLR article 78 proceeding transferred to this Court by order of Supreme Court, Wyoming County (Dadd, J.), entered October 16, 2001, seeking to annul a determination of respondent after a Tier III hearing.

Wyoming County-Attica Legal Aid Bureau, Attica (Norman P. Effman of counsel), for petitioner.

Eliot Spitzer, Attorney General, Albany (Nancy A. Spiegel of counsel), for respondent.

PRESENT: GREEN, J.P., HAYES, HURLBUTT, KEHOE, AND BURNS, JJ.


ORDER

It is hereby ORDERED that said proceeding be and the same hereby is unanimously dismissed without costs as moot ( see, Matter of Free v. Coombe, 234 A.D.2d 996).
