Matter of Brown v. Ushco Manufacturing Co., Inc.

Appellate Division of the Supreme Court of New York, Third Department
Jan 13, 1943
265 App. Div. 1026 (N.Y. App. Div. 1943)

Opinion

January 13, 1943.

Appeal from State Industrial Board.

Present — Hill, P.J., Crapser, Bliss, Heffernan and Schenck, JJ.

Claimant was employed in a drop forge shop and worked around hot forgings. On several different dates between December 3, 1940, and January 10, 1941, he was struck in the face by particles of hot metal flying from the forgings, from which he sustained burns and resulting scars. These scars varied in length from one-fourth inch up to one inch. The contention of the appellants is that each of the accidents and scars must be considered separately, and that no one scar constituted serious facial disfigurement. The State Industrial Board found six separate accidents and resulting scars, and made one award for the aggregate serious facial disfigurement. Award unanimously affirmed with costs to the State Industrial Board.
