Matter of Brandt v. Louis York

Court of Appeals of the State of New York
Oct 17, 1986
68 N.Y.2d 889 (N.Y. 1986)

Opinion

Argued October 15, 1986

Decided October 17, 1986

Appeal from the Appellate Division of the Supreme Court in the First Judicial Department, Francis N. Pecora, J.

Michael S. Feldberg for appellant.

Douglas A. Kellner and Judith Bader-York for Louis York, respondent.

Frederick A.O. Schwarz, Jr., Corporation Counsel (Terrance Real of counsel), for Board of Elections in the City of New York, respondent.

Order affirmed, without costs. Because the proceeding was not commenced in compliance with Election Law §§ 16-102 and 16-116, Supreme Court never acquired jurisdiction. The petition was, therefore, properly dismissed.

Concur: Judges MEYER, SIMONS, ALEXANDER, TITONE and HANCOCK, JR. Taking no part: Chief Judge WACHTLER and Judge KAYE.
