Opinion

December 27, 1960

In three proceedings pursuant to article 78 of the Civil Practice Act, two of them being brought by the individual petitioners as directors and the third being brought by the corporate petitioner as a stockholder of a holding corporation, Greenwald Industries, Inc., to inspect and examine the books and records of the holding corporation and of five of its wholly owned subsidiary corporations, said holding corporation appeals from three orders of the Supreme Court, Nassau County, dated June 17, 1960, granting the respective petitions and directing the inspection and examination of such books and records, and denying its several cross motions to dismiss the petitions. The appeals were consolidated and heard together on one record. Orders affirmed, with one bill of costs. No opinion. The inspection and examination shall proceed on 10 days' written notice or on any other date mutually fixed by the parties. Beldock, Acting P.J., Ughetta, Christ and Pette, JJ., concur.
