Decided October 1, 1964
Motion to amend remittitur granted. Return of remittitur requested and, when returned, it will be amended by adding thereto the following: Petitioner contended that the order directing his retrial upon the charge of carnal abuse as a felony would deny him due process of law and the equal protection of the laws under the Fourteenth Amendment of the United States Constitution. The Court of Appeals, passing upon such contention, held that there was no violation of petitioner's constitutional rights.
