Matter of Billie v. Billie

Appellate Division of the Supreme Court of New York, Second Department
Oct 25, 1967
28 A.D.2d 1005 (N.Y. App. Div. 1967)

Opinion

October 25, 1967

Judgment of the Family Court, Westchester County, dated July 10, 1967, modified, on the law and the facts, so as to reduce the term of imprisonment to the time served. As so modified, judgment affirmed, without costs. Appellant was sentenced to the Westchester County Penitentiary for six months based on his violation of a prior Family Court order of protection dated July 5, 1967. He has served three and one-half months of that sentence. We think that the sentence is excessive to the extent indicated and should be reduced to the time already served by him. Christ, Acting P.J., Brennan, Rabin, Hopkins and Munder, JJ., concur.
