Matter of Belle Banks

Appellate Division of the Supreme Court of New York, Second Department
Jan 25, 1943
265 App. Div. 1013 (N.Y. App. Div. 1943)

Opinion

January 25, 1943.

Present — Close, P.J., Hagarty, Carswell, Taylor and Lewis, JJ.

Order of the Surrogate's Court, Westchester County, allowing the claim of the respondents and awarding to them certain costs and disbursements, modified on the facts by reducing from $773.30 to $573.30 the costs and disbursements awarded to respondents. As thus modified, the order is unanimously affirmed, without costs. In our opinion the allowance of $600 to respondents for preparing for trial was excessive, and $400 is adequate therefor.
