Matter of Baker v. McCaffery

Appellate Division of the Supreme Court of New York, Third Department
Sep 23, 1942
264 App. Div. 968 (N.Y. App. Div. 1942)

Opinion

September 23, 1942.

Present — Hill, P.J., Crapser, Heffernan, Schenck and Foster, JJ.

Claimant was injured while cleaning out an oil well. The employer testified he was employed as an employee and not an independent contractor and it would be impossible to let a contract for that kind of work. The evidence supports the award. Award unanimously affirmed, with costs to the State Industrial Board.
