Matter of Axley v. O'Connell

Appellate Division of the Supreme Court of New York, First Department
Oct 16, 1951
279 App. Div. 575 (N.Y. App. Div. 1951)

Opinion

October 16, 1951.

Present — Peck, P.J., Glennon, Dore, Callahan and Van Voorhis, JJ.

Order unanimously reversed and the determination of the respondents-appellants confirmed, with $50 costs and disbursements. We think the refusal of the State Liquor Authority to renew petitioners' restaurant liquor license was not an abuse of its authority. Settle order on notice.
