Matter of Apfel

Appellate Division of the Supreme Court of New York, Third Department
Nov 18, 1942
265 App. Div. 899 (N.Y. App. Div. 1942)

Opinion

November 18, 1942.

Appeal from Unemployment Insurance Appeal Board.

Present — Hill, P.J., Crapser, Heffernan, Schenck and Foster, JJ.

The sole issue presented is whether as a matter of law these claimants were employees. Claimants were engaged by contract as representatives of the appellant to solicit industrial insurance policies and to collect for the appellant weekly premiums from all policy holders in their territory. The evidence sustains the finding of the Board that claimants were employees of appellant, and the decision should be affirmed. Decision unanimously affirmed, with costs to the State Industrial Commissioner.
