Matter of A.M. Jordan, LTD

Appellate Division of the Supreme Court of New York, First Department
Nov 14, 1949
276 App. Div. 756 (N.Y. App. Div. 1949)

Opinion

November 14, 1949.

Present — Dore, J.P., Cohn, Callahan, Van Voorhis and Shientag, JJ.

Judgment and order unanimously reversed, with costs to the appellant, and the matter remitted to the arbitrators to determine, in dollars and cents, the amount of the award in accordance with all the terms of the contract, including allowances for insoluble impurities and expenses, if any, and the provision with respect to payment in pounds. The difficulty here presented is there is on the face of the record an unexplained disparity between the award of the arbitrators and the amount of the judgment directed to be entered thereon. Settle order on notice.
