Appeal from Workmen's Compensation Board.

Present — Foster, P.J., Heffernan, Brewster, Santry and Bergan, JJ. [See post, p. 934.]


There was evidence which sustains the findings of the board on the questioned issue of dependency. The compromise or final settlement of the third-party action which was approved by the Surrogate's Court did not require the written consent of the insurance carrier as called for by section 29 Work. Comp. of the Workmen's Compensation Law. Decision and award unanimously affirmed, with costs to the Workmen's Compensation Board.
