Petition granted and determination annulled, on the law, without costs or disbursements, the petitioner is declared not to be an employable person, as defined in 18 NYCRR 385.1, and respondents are directed to continue her grant of home relief assistance.

As the State Commissioner concedes, the determination must be annulled because it was not supported by substantial evidence. Mangano, J.P., Brown, Niehoff and Lawrence, JJ., concur.
