Opinion

Appeal from Unemployment Insurance Appeal Board.


The evidence sustains the findings of the Board and hence the decision is affirmed with costs to the Industrial Commissioner. Appellant has criticised the Board for refusing to take additional testimony. The evidence offered was of doubtful materiality and, in no event, could it have changed the result. The court believes, however, that when competent evidence is offered, and a reasonable excuse is presented for submitting the same to the Board, the Board should then in the exercise of a sound discretion receive it. Decision affirmed, with costs to the Industrial Commissioner. All concur.
