1593 Fulton Street Bar & Grill, Inc. v. O'Connell

Appellate Division of the Supreme Court of New York, Second Department
Jun 28, 1948
274 App. Div. 819 (N.Y. App. Div. 1948)

Opinion

June 28, 1948.

Determination of State Liquor Authority annulled and the matter remitted to said authority for a rehearing in order to determine specifically the issue of fact as to whether the persons observed drinking after the closing hour were employees of petitioner, as claimed. On the record before us the proof as to this issue is meager and the authority apparently railed to make any determination thereon. Lewis, P.J., Carswell, Johnston, Adel and Wenzel, JJ., concur.
