The questions involved in this appeal are identical with those determined by this court in Reese v. Resburgh, decided at this term ( ante, p. 378), and the judgment appealed from should, therefore, be affirmed, with costs, upon the opinion in that case. Van Brunt, P.J., Patterson, O'Brien and Ingraham, JJ., concurred.
