1. The order dated May 17, 2000 is vacated.

2. The motion of Agovino Asselta LLP for leave to withdraw as counsel for defendant Empire State Restoration Corp. ("ESRC") is granted. The action against ESRC is severed from the remainder of this action, stayed for 30 days to permit it to obtain counsel, and placed on the suspense docket.
