Martinez v. Sharon Associates, Inc.

Appellate Division of the Supreme Court of New York, Second Department
Feb 25, 2002
291 A.D.2d 535 (N.Y. App. Div. 2002)

Opinion

2001-08496

Argued January 24, 2002.

February 25, 2002.

In an action to recover damages for personal injuries, etc., the defendants appeal from an order of the Supreme Court, Kings County (M. Garson, J.), dated September 5, 2001, which denied their motion for summary judgment dismissing the complaint.

Connors Connors, P.C., Staten Island, N.Y. (Lucia DiChiara of counsel), for appellants.

Rimland Associates (Pollack, Pollack, Isaac DeCicco, New York, N.Y. [Brian J. Isaac and Julie T. Mark] of counsel), for respondents.

Before: GLORIA GOLDSTEIN, J.P., WILLIAM D. FRIEDMANN, LEO F. McGINITY, HOWARD MILLER, JJ.

ORDERED that the order is affirmed, with costs.

The Supreme Court properly denied the defendants' motion for summary judgment since there are issues of fact (see, Zuckerman v. City of New York, 49 N.Y.2d 557).

GOLDSTEIN, J.P., FRIEDMANN, McGINITY and H. MILLER, JJ., concur.
