The Court's records indicate that Appellants' notice of appeal, filed on August 27, 2024, may not have been timely filed to appeal the trial court's judgment, signed on March 14, 2023. See Tex. R. App. P. 26.1 (requiring notice of appeal to be filed within thirty days after judgment is signed or ninety days after judgment is signed if party timely files motion for new trial). On October 17, 2024, the Clerk of the Court sent Appellants a Notice of Intent to Dismiss, informing them their appeal may be dismissed for lack of jurisdiction unless, within 14 days of the date of the Notice, Appellants filed a written response.
On October 22, 2024, Appellants filed a "Motion for Extension of Time to File Merito[]rious Answer," requesting an additional 60 days to respond to the Court's Notice.
The Motion is granted only to the extent that Appellants must file a response, with citation to the record, statutes, rules, and case law, demonstrating that this Court has jurisdiction over their appeal, on or before Friday, December 20, 2024. No further extensions will be granted.
If a meritorious response is not received by the deadline, the Court may dismiss the appeal for lack of jurisdiction without further notice. See Tex. R. App. P. 42.3(a).
