MANOLO BERNAL MARTINEZ-ROMERO, Appellant v. THE STATE OF TEXAS, Appellee
On Appeal from the 203rd Judicial District Court Dallas County, Texas
Trial Court Cause No. F13-12775-P
ORDER
Before the Court is appellant's motion to supplement the record and reset the briefing schedule. Specifically, appellant asks that we order a supplemental reporter's record to include three exhibits offered and admitted during three separate court proceedings.
During the September 15, 2015 hearing on appellant's agreed plea, the State offered appellant's judicial confession; in volume 2 of the reporter's record, the court reporter notes that document was "Contained in Court's File." Volume 3 of the reporter's record is the February 14, 2017 hearing on the State's motion to revoke probation during which the State offered appellant's plea of true and stipulation of evidence. And, in volume 4 of the reporter's record, during the July 22, 2019 hearing on the State's motion to revoke probation, the State offered appellant's plea of true; the court reporter noted that document was "Retained in Court's File." Our review shows that each of these documents is already contained in the clerk's record filed on September 27, 2019 with the Court. Therefore, we DENY as moot appellant's motion to the extent he requests a supplemental record with these documents.
We GRANT appellant's motion to the extent he requests additional time to review the record and file his brief. We ORDER appellant's brief due on or before April 3, 2020.
