ORDER TO DISMISS FOR FAILURE TO AMEND


TO ALL PARTIES AND THEIR ATTORNEYS OF RECORD:

The Motion to Dismiss of defendant Salt Lake Community College came on regularly for hearing on May 28, 2004. Chad Steur, Assistant Attorney General, appeared on behalf of defendants. Plaintiff was represented by D. Bruce Oliver.

The Court, on May 28, 2004, after reviewing the memoranda of the parties, and hearing oral argument, and for good cause, Ordered as follows:

1. The Motion is taken under advisement.

2. Plaintiff is granted 30 days to file an amended complaint.

3. The Motion will be granted if plaintiff fails to amend within 30 days.

The Court Ordered 30-day period for filing an amended complaint has elapsed, and plaintiff has failed and refused to file an amended complaint.

NOW THEREFORE, IT IS HEREBY ORDERED, ADJUDGED AND DECREED that the Complaint, and each of the causes of action therein contained, be dismissed.
