ORDER RE: MOTION TO DISMISS
On May, 27, 2004, in the Central Division of the above-entitled Court, the Motion to Dismiss of Defendant Salt Lake Community College came on regularly for hearing.
Chad M. Steur appeared on behalf of Defendant and moving party. D. Bruce Oliver appeared on behalf of Plaintiff.
Based upon the Motion to Dismiss of Defendant Salt Lake Community College, the Opposition of Plaintiffs Christine Martin and Nancy Grissetti, the Reply of Defendant Salt Lake Community College, and oral argument of counsel on May 27, 2004, it is hereby ORDERED, ADJUDGED and DECREED as follows:
The Motion to Dismiss is taken under advisement and the Plaintiffs are granted 30 days leave to amend the Complaint, up to and including June 28, 2004. If the Plaintiffs fail to amend, the Motion to Dismiss will be granted.
Further, the Motion to Strike is granted as to the allegation and prayer for punitive damages.
