Martin v. Janus Real Estate Group

Court of Appeals of Texas, Fifth District, Dallas
May 12, 2009
No. 05-09-00080-CV (Tex. App. May. 12, 2009)

Opinion

No. 05-09-00080-CV

Opinion issued May 12, 2009.

On Appeal from the County Court at Law No. 6 Collin County, Texas, Trial Court Cause No. 006-3308-2008.

Before Justices BRIDGES, O'NEILL, and FITZGERALD.

MEMORANDUM OPINION

The Court has before it appellee's motion to dismiss the appeal and to award appellee attorneys' fees. One of the grounds for seeking the dismissal is that appellant has not filed a brief. Appellant did not respond to the dismissal motion, nor has she filed a brief in the appeal. We deny the motion to the extent appellee seeks attorneys' fees. We grant the motion to the extent appellee seeks dismissal of the appeal.

We dismiss the appeal for want of prosecution. See Tex. R. App. P. 38.8(a), 42.3.
