RICHARD MARTIN, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Alina I. Marshall, Judge

This case was continued from the Court's April 8, 2024, Philadelphia, Pennsylvania trial session based on respondent's Status Report, filed March 14, 2024, indicating that this case had settled and respondent was awaiting a signed stipulated decision from petitioner. The Court served on Order on March 29, 2024, requiring the parties to file either a proposed stipulated decision or status report, on or before May 13, 2024. On April 2, 2024, respondent filed a Motion to Dismiss for Lack of Prosecution. Premises considered, it is

ORDERED that petitioner shall, on or before May 13, 2024, file with the Court a response or objection to respondent's aforementioned motion. Petitioner is advised that failure to respond to this Order or failure to meaningfully participate in the prosecution of this case may result in the granting of respondent's motion to dismiss, and a decision entered against petitioner for the amount and for the year set forth in that motion.
