On Remand from the Alabama Supreme Court


In accordance with the judgment of the Alabama Supreme Court, we dismiss the petitioner's appeal. The proper vehicle for the petitioner's claims is a petition for a writ of mandamus, not a petition filed pursuant to Rule 32, Ala. R. Crim. P. See Marshall v. State, 884 So.2d 900 (Ala. 2003).

APPEAL DISMISSED.
