Marshall v. State

District Court of Appeal of Florida, Third District
Apr 12, 2000
755 So. 2d 778 (Fla. Dist. Ct. App. 2000)

Opinion

No. 3D00-805.

Opinion filed April 12, 2000.

An Appeal under Fla.R.App.P. 9.140(i) from the Circuit Court for Dade County, Marc Schumacher, Judge, L.T. No. 96-4696.

Anthony Marshall, in proper person.

Robert A. Butterworth, Attorney General, for appellee.

Before LEVY, GODERICH, and RAMIREZ, JJ.

The defendant challenges his sentence as a Violent Career Criminal under the "Officer Evelyn Gort and All Fallen Officers Career Criminal Act" on the ground that chapter 95-182, the enacting legislation, violated the single subject requirement of the Florida Constitution. Based upon the Florida Supreme Court's opinion in State v. Thompson, 25 Fla. L. Weekly S1 (Fla. December 22, 1999), we reverse.

Accordingly, we remand to the trial court for resentencing.

Reversed and remanded.
