[NO CHANGE IN JUDGMENT]

THE COURT:

It is ordered that the opinion filed herein on October 2, 2003, be modified as follows:

1. On page 9, the last sentence of the second full paragraph, the word "held" is be changed to "assumed" so the sentence reads:

Even though there was no present entitlement, Lujan assumed that the subcontractor still had a property interest at stake and was therefore entitled to receive due process.
