In an action to recover damages for assault, false arrest and false imprisonment, the third-party plaintiff appeals from an order of the Supreme Court, Richmond County, dated April 12, 1961, granting the motion of the third-party defendant, made pursuant to subdivision 4 of rule 106 of the Rules of Civil Practice, for judgment dismissing the third-party complaint. Order affirmed, with $10 costs and disbursements. No opinion. Nolan, P.J., Ughetta, Christ, Pette and Brennan, JJ., concur.
