Petitioner-respondent having moved for permission to respond to the appeal taken herein from an order of the Family Court, Genesee County, entered in the Office of the Clerk of said Court on March 14, 2011, as a poor person, and for assignment of counsel,

Now, upon reading and filing the affidavit of Ursula Marquardt, sworn to December 23, 2011, the notice of motion with proof of service thereof, the affidavit of Charles N. Zambito, Esq., sworn to December 30, 2011, and the affirmation of Charles J. Greenberg, Esq., dated January 3, 2012, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted, and

It is further ORDERED that Charles J. Greenberg, Esq., PO Box 102, Buffalo, New York 14207-0102, is hereby assigned as counsel for petitioner-respondent herein and may submit ten copies of respondent's brief reproduced in accordance with CPLR 5529.
