We REINSTATE the appeal.

On October 28, 2022, the Court granted appellate counsel's motion to withdraw and abated the case so the trial court could determine whether appellant desired to proceed pro se or whether new counsel should be appointed. A supplemental clerk's record has been filed showing the trial court has made findings that (1) new counsel should be appointed, and (2) appellant does not desire to waive his right to counsel and proceed pro se. The trial court has appointed Marcus T. Olds to represent appellant. We ADOPT the trial court's findings.

We DIRECT the Clerk to substitute Marcus T. Olds as appellant's counsel and send all future correspondence to Marcus T. Olds; Olds & Brown, PLLC; 111A N. Travis Street #5; Sherman, Texas 75090; telephone: (903) 609-1598.

We ORDER appellant's counsel to review the record and, by December 30, 2022, file (1) an amended brief replacing the September 12, 2022 brief filed by former counsel; or (2) file a supplemental brief and notify the Court that counsel is adopting the September 12, 2022 brief as supplemented.
