Present — Ingraham, P.J., McLaughlin, Laughlin, Scott and Dowling, JJ.; Ingraham, P.J., and McLaughlin, J., dissented and voted for reversal as against the weight of evidence.


Judgment and order reversed and new trial ordered, with costs to appellant to abide event, unless plaintiff stipulate to reduce verdict to the sum of $7,500, in which event the judgment as so reduced and the order appealed from are affirmed, without costs. No opinion. Order to be settled on notice.
