MEMORANDUM OPINION

Appellant Darren Marlen appealed a summary judgment rendered against him. Appellant now files a Motion to Dismiss Appeal asserting that the parties have reached a resolution to the underlying case. See TEX. R. APP. P. 42.1(a).

Appellant's motion is granted, and this appeal is dismissed. There being no agreement as to costs, all costs of the appeal are taxed against appellant.
